Trading Platform Terms

Moscord Pte Ltd (“Moscord”) provides website features and other services to you when you visit, list products on and place orders via www.Moscord.com (the “Trading Platform”) or use software provided by Moscord in connection with any of the foregoing (collectively “Moscord Services”).
This Trading Platform Terms (the “Terms”) and all policies posted on our sites set out the terms on which Moscord offers you the Moscord Services. You agree to the terms and conditions of these Terms when you register on www.Moscord.com. All policies are incorporated into these Terms. You agree to comply with all of the above when accessing or using Moscord Services.
Customers trust that they can be confident of the transactions they make using the Trading Platform. Therefore, when selling on our website, there are important requirements you must follow to ensure a great experience for customers. The products you offer for sale on the Trading Platform must comply with your supplier agreement, including all applicable Moscord policies and all applicable laws and regulations. Understanding and complying with these requirements is vital for successful selling. All suppliers are expected to adhere to the following policies when listing products on the Trading Platform. Non-compliance with the following policies may result in suspension of your Moscord account.
Please read these terms carefully before using Moscord Services. By using Moscord Services, you signify your agreement to be bound by these Terms. We offer a wide range Moscord Services, and sometimes additional terms may apply. When you use a Moscord Service (for example Moscord Invoicing System, or Moscord Order Fulfilment Service, you will also be subject to the terms, policies and conditions applicable to that Moscord Service (“Service Terms”). If the terms of these Terms are inconsistent with the Service Terms, those Service Terms will control.

The Trading Platform is an internet platform where you may list products for sale on the Trading Platform and customers may view or place orders to purchase the products listed on the Trading Platform.
Product Listings & Catalogue Content
When you create product listings on the Trading Platform, you may submit details of the products (“Catalogue Content”) to be displayed on the Trading Platform when customers view your products. When you create product listings, you agree that the products listed are in compliance with these Terms and other Moscord policies. When you submit Catalogue Content, you are responsible for the accuracy, content and legality of the listing and item offered.
Despite our best efforts to offer reliable information to our customers, we cannot promise that the Catalogue Content will always be accurate and up-to-date, and you agree that you will not hold us or our service providers responsible for inaccuracies in the Catalogue Content.
The following products are not to be listed on the Trading Platform:
- Products that infringe, misappropriate or otherwise violate any third party’s Proprietary Rights
- Products that do no conform to the requirements of applicable Law, including all applicable health, safety and environmental regulations
- Products that are old or used where the Products are represented to be new and unused
- Products that are unmerchantable and not fit for customers’ purposes
- Products that you are not authorized to lawfully sell or produce
- Products without valid intellectual property licences
Purchase Order & Confirmation Order
When we receive an order from a customer (“Purchase Order”), we will forward the Purchase Order to you. You have sole and absolute discretion to accept the Purchase Order. Upon acceptance of the Purchase Order, you agree to issue a confirmation order to us (“Confirmation Order”) and we will forward the Confirmation Order to the customer. To ensure that all users have a better transaction experience, we will only forward Purchase Orders and Confirmation Orders which are compliant with these Terms and other Moscord policies. When you issue the Confirmation Order, you agree that you are responsible for the sale of the products and for dealing with any customer claims or any other issue arising out of or in connection with the contract between the you and customer.
We charge our fees according to the services that you request. We may change fees or introduce new fees from time to time by posting posting the changes on the Trading Platform site and via a Moscord Message directly to you 30 days in advance.
As a supplier, you are liable for transaction fees arising out of all sales made using some or all Moscord Services.
While Moscord facilitates the transactions carried out via the Trading Platform by (1) providing, operating and maintaining the Trading Platform, (2) listing the your products and updating catalogue content, (3) receiving customers’ purchase orders for the listed products, (4) forwarding the Purchase Orders to you, (5) forwarding the Confirmation Orders to customers and (6) providing additional requested Moscord Services (for example Invoice System or Order Fulfilment Service), Moscord does not have possession of any product listed or sold through the Trading Platform and Moscord is neither the buyer nor the seller of the listed products.
As we are neither the seller or buyer of the product, any contract for the confirmed sale of the product is solely between supplier and customer. We are not a party to this contract, we do not assume any responsibility arising out of or in connection with it and we are not your agent. You are responsible for the sale of the products and for dealing with any customer claims or any other issue arising out of or in connection with the contract between you and the customer.
Maintaining a trusted marketplace for customers and suppliers is our top priority. We are constantly improving the services we offer and closely monitor the use of our trading platform. When we identify a violation of our policies, we take appropriate action which may include suspending or removing your supplier privileges.
